These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and ClutterFly (“ClutterFly,” “we,” “our,” or “us”) governing your access to and use of the ClutterFly mobile application and related services (the “Application” or “Service”).
By accessing or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. Eligibility
You must be at least 16 years old to use the Application.
If you are under the age of majority in your jurisdiction but at least 16 years old, you represent that you have permission from a parent or legal guardian to use the Service and that they have reviewed these Terms.
The Application is not intended for children under 16.
2. Description of the Service
ClutterFly is a mobile application designed to assist users in managing and organizing files stored on their devices.
The Application may provide features including:
- Identifying duplicate, blurry, or similar media files
- Moving, sharing, or deleting files selected by the user
- Moving files to Trash on supported Android versions
- Organizing files into folders such as Images, Videos, Audios, Documents, Downloads, My Folder, Favorites, and Trash
- Lock Folder functionality to restrict access within the app interface
Media analysis and file operations are performed locally on your device.
ClutterFly does not upload or store your photos, videos, or other files on external servers.
The Application may display advertising to support the free version of the Service.
We reserve the right to modify, suspend, or discontinue features of the Application at any time.
3. User Responsibilities
You are solely responsible for:
- The media files stored on your device
- Reviewing files before deletion
- Ensuring that you maintain backups of important data
- Any file movement, deletion, locking, or sharing actions initiated through the Application
ClutterFly is not responsible for accidental deletion of files initiated by the user.
You agree not to:
- Use the Application for unlawful purposes
- Attempt to reverse engineer or decompile the Application
- Interfere with the operation or security of the Service
- Use the Service in a way that violates applicable laws or platform policies
4. License Grant
Subject to these Terms, ClutterFly grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for personal, non-commercial use.
All intellectual property rights in the Application, including software, trademarks, logos, graphics, and design elements, remain the property of ClutterFly and its licensors.
No rights are granted except as expressly stated in these Terms.
5. Advertising-Supported Service
The Application may display advertising provided by third-party advertising services.
By using the Application, you acknowledge and agree that:
- Advertising may be displayed within the Application.
- Third-party advertising services may collect device identifiers (including
advertising identifiers), usage data, diagnostic data, and advertising
interaction data in accordance with their own privacy policies.
- Personalized advertising may be delivered where permitted by law and subject to user consent.
On iOS devices, permission to track across apps and services is requested through Apple’s App Tracking Transparency (ATT) framework.
ClutterFly does not control and is not responsible for the content, products, or services offered by third-party advertisers.
6. Third-Party Services
The Application integrates third-party services including:
- Advertising services
- Analytics services (including Firebase Analytics)
- Platform services (such as Google Play Services)
These services may collect device identifiers (including advertising identifiers), usage data, diagnostic data, and advertising interaction data according to their own privacy policies.
ClutterFly does not control the data practices of third-party providers.
7. Privacy
Your use of the Application is governed by our Privacy Policy.
By using the Application, you acknowledge that data collection and processing may occur as described in the Privacy Policy, including advertising and analytics processing.
8. Disclaimer of Warranties
The Application is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, ClutterFly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Application will be uninterrupted
- The Application will be error-free
- The Application will meet your expectations
9. Limitation of Liability
To the maximum extent permitted by law, ClutterFly shall not be liable for:
- Loss of data
- Accidental deletion of files
- Indirect, incidental, special, consequential, or punitive damages
- Damages exceeding the amount you paid for the Service (if any)
You acknowledge that use of the Application is at your own risk.
10. Indemnification
You agree to indemnify and hold harmless ClutterFly, its affiliates, officers, and licensors from any claims, damages, liabilities, or expenses arising from:
- Your misuse of the Application
- Your violation of these Terms
- Your violation of applicable laws
11. Termination
We may suspend or terminate your access to the Application if you violate these Terms or engage in conduct that harms the Service or other users.
You may discontinue use at any time by uninstalling the Application.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClutterFly is legally established, without regard to conflict of law principles.
Nothing in these Terms limits mandatory consumer protection rights under applicable law.
13. Changes to These Terms
We may update these Terms from time to time. Updated versions will reflect a revised “Last Updated” date.
Continued use of the Application after changes become effective constitutes acceptance of the revised Terms.
